What employee benefits in Corpus Christi have to handle
Most of what makes a benefits program work or fail in Texas is decided before anyone picks a plan: how many employees you have, how you contribute, when people can enroll, and which notices you owe. Here is the framework we walk Coastal Bend employers through.
1. Who counts as a small employer in Texas
The Texas Department of Insurance defines a small employer as a business with 2 to 50 eligible employees. That group is guaranteed issue under Texas Insurance Code Chapter 1501 — a carrier in that market cannot refuse your group or rate it because of your employees’ health. Rates vary by factors such as age and location, not by anyone’s medical history.
2. The 50-employee line most owners are asking about
Being able to buy coverage and being required to offer it are two different questions. Under the IRS employer shared responsibility rules, the obligation to offer coverage begins at 50 full-time and full-time-equivalent employees (an applicable large employer). Below that line offering benefits is a retention decision, not a mandate — which is exactly why the package design matters.
3. Participation and contribution rules — where quotes actually turn
Carriers set minimum participation and minimum employer contribution levels, and a group that misses them can be declined outside of one window. Federal rules at 45 CFR 147.104(b)(1) require carriers in the small group market to offer coverage each year from November 15 to December 15 without applying those participation and contribution rules, for a January 1 effective date. If your census is thin or your contribution is light, that window is your plan B — and it is easy to miss.
4. Enrollment: new hires, life events, and the pre-tax plan
Texas small employer plans must give new employees at least 31 days to enroll. Federal special enrollment rights give employees at least 30 days after events such as marriage, birth, adoption, or loss of other coverage (29 CFR 2590.701-6). If you run premiums pre-tax, that is a Section 125 cafeteria plan, which requires a written plan document, and elections stay locked for the year unless there is a consistent change in status (26 CFR 1.125-4). Employers who skip the written document are the ones who discover the problem during an audit.
5. The paperwork that arrives with the plan
A benefits plan is an ERISA plan. That means a Summary of Benefits and Coverage, at least 60 days’ advance notice of a mid-year material modification (29 CFR 2590.715-2715), and a Summary Plan Description for participants (29 CFR 2520.102-3). Many small, fully insured or unfunded plans with fewer than 100 participants are exempt from filing a Form 5500 under 29 CFR 2520.104-20 — but the exemption has conditions, so confirm yours rather than assuming it.
6. What happens when someone leaves
Federal COBRA applies at 20 or more employees. Smaller Texas groups are not off the hook: state continuation under Texas Insurance Code § 1251.255 and 28 TAC § 21.5310 gives an eligible former employee up to nine months of continuation (six months if COBRA has been exhausted), and the election notice timing runs on a 60-day clock. On a coast where seasonal and hourly turnover is normal, this is the rule small employers trip over most.
7. Two items worth asking your accountant about
Employers with fewer than 25 full-time-equivalent employees who contribute a uniform 50% or more toward premiums and buy through the SHOP market may qualify for the small business health care tax credit under IRC § 45R, claimed on IRS Form 8941 for two consecutive years.
